Lawyers for Sean "Diddy" Combs have motioned for a mistrial after witnesses for the prosecution allegedly provided "false" testimony.
According to a report TMZ published on Saturday, June 7, Combs' attorneys accused the government of presenting testimony they believe is not true. Their request came after Cassandra "Cassie" Ventura's friend Bryana Bongolan took the stand and alleged Combs dangled her over a balcony 17 stories high. Diddy's team pointed out holes in the testimony from Bongolan and Cassie about the alleged incident. They referred to photos of Bongolan's injuries that the prosecution presented last week.
Bongolan testified that Combs allegedly picked her up and hung her over the edge of the balcony for 10-15 seconds. She also told the jury that he pulled her back onto the balcony and then slammed her into some nearby furniture. She also claimed Cassie was there and confronted Combs about it.
Bongolan said she sustained injuries to her neck and leg, which were displayed in the photos. According to the image's metadata, the photos were taken on September 26, 2016. Combs' attorneys provided evidence that the mogul was on the East Coast on that date, which proved he couldn't have caused the injuries in the photos.
Cassie also mentioned the incident in her testimony at the top of the trial. She claimed she saw her ex dangle Bongolan over the balcony. In evidence Diddy's attorneys highlighted, Cassie texted Combs' trusted employee Kristina Khorram that she "just found out some crazy s**t," which could mean that she didn't witness the incident. Even Bongolan claimed the heated interaction happened "on or about" September 26 in her lawsuit. Prosecutors also clarified that Cassie's text to KK suggested that the incident happened later in the week around September 29 or 30.
As of this report, Judge Subramanian has not ruled on the request. It's the second time Combs' defense team has requested a mistrial.
